Publishers are risk averse idiots. Granted, reproducing an entire song poses a problem, but I'd bet a stanza or so would be fair use. The problem is that the threat of a suit, even one that isn't well-founded, is enough to scare them. And thus the norms that really drive the behaviors of artists and business people--as opposed to the law--are shifted toward risk aversion, and nobody wants to buck them. Of course, you could try to get permission.

You're welcome, Jeff g., unless you're a publisher, and you were being sarcastic, and I've offended you, in which case I'm sorry for painting all publishers as risk averse idiots with one sweep of a broad brush.

You could also parody the lyric, Amanda, which might very well undermine the whole point of quoting it in the first place. I am reminded of a cartoon my kids watch in which a character appears, Jason Wiebler, who sings a song, "Sweety, Sweety." I had to explain to them that the character was a parody of Justin Bieber.

You've got to be a Stephen King or someone on his level before publishers lay out coin on song permissions for your work. It's almost easier to make up a fake song to quote from (which he did in "The Stand," I guess, but he still could've told his pub. he wanted half of "Hard Day's Night" and they'd likely have run off w/ check in hand).

I actually have come to find it a bit obnoxious when people quote song lyrics too much, because they're usually referencing a song that the reader is meant to know anyway. Musicians do it in their memoirs and it can be hilariously self-aggrandizing.

At my final full-time job, colleagues of mine and I received training on how to use a new video camera, purchased so we could ask conference attendees innocuous questions about the nursing profession and record their responses for use on the magazine's website. THEN we were shown the release form we had to have respondents sign. Two sides of a legal-sized sheet covered w/ fine print invoking all manner of illusory legal horrors. The report back from the conference was that lots of nurses were interested in chatting, but none of them did so upon seeing this Faustian fucking contract.

Additionally, I think there are ways around writing about pop music in fiction without directly quoting lyrics. George Pelecanos does it a lot. If they're being used for more than just window dressing (which it sounds like might have been the case with your story Amanda), you can always go with fair use, too.

I *might* be misrepresenting the law with respect to lyrics (as opposed to any other genre of the written word), but fair use permits quoting portions of Henley & Frey for the purpose of commenting on nature of the comment--criticism, instruction, parody, approval, etc.--and in terms of the nature of the commenting text--non-fiction, fiction, tabular data, etc. Thus, if I were emperor, even a fictional short story that quotes one or two stanzas of a well-known Eagles tune to depict a character's reverie respecting those lyrics would easily satisfy fair use.
