Hi Julie! This week I just had to go back to the Archive and listen to the Emile Simon performance and interview, and I'm sure I'll listen to it again, it was that good. I had planned to go to Summerstage on Saturday, then couldn't make it. I assume you were there and the show was great?

Being in German rights society GEMA the option for other licensing is finished for livetime. (Hard to believe but true.) Just asking ...

US copyright law recognizes a mechanical reproduction, a live performance, or a "song" (definitions vary with your choice of attorney). Performer's rights societies might be involved in one or more of those. Things get ugly quickly over very little, and FMA has little incentive to fight.

Thanks for the info! Roiughly the same here.
The thing is with composers rights.
If you are a member of GEMA you make a kind of live-long contract, that from that point in your live you must distribute everthing you creat with the GEMA and international partners involved. You are even not allowed to put somthing to public domain, nor Creative Commons or even just put sth. to Youtube for self promotion. (There are protests and sues against this. But no solutions yet.)

There's a good English Wikipedia page for GEMA, but I'm immediately puzzled by the concept of three classes of "professional". I have some schadenfreude GEMA is stuck playing catch-up with technology just like everywhere else...

In some ways GEMA sounds cool, in the US you're on you're own and you end up publishing through ASCAP or BMI or some other smaller-scale accounting fiasco. At least it's all public record with GEMA.

@Guido I'm 100% certain that if you asked Chris Isaak if he thought Emilie Simone's performance of Wicked Game during a live in-station set should go on The Free Music Archive he would say ( as the songwriter): "sure! no worries!" But he has contracts with various entities that each own a piece of his income, and that's the real reason it's blocked-- we're a religiously capitalist nation that's lagging behind Europe in recognizing intellectual commons of many kinds.

They were nominated for a Dallas Observer Music Award for Best Americana Band a couple of years ago. They got a lot of publicity locally when they requested that their nomination be rescinded.

There are some advantages in German law that preven the artist form fooleries. Like it is not possible to sell an authorship away completely.

On the other hand GEMA is so incredibly old fashioned. They rely on the good old method to gather music licence money by visiting shops and listen after public radio doodeling. They sue YouTube ... wich basically is not too wrong ... since big company is living on bootlegging in the very end.

But I think it would have been the very duty of the rights societies to set up asomething like sopztify in the very dawning of MP3 ... it would have been the justest system of music licencsing imaginable. Instead they imped musicians on using modern methods of self promotion. It is so plain annoying.

A guy like Isaak is a fairly substantial business. He has representation, management, record company, etc. who each own a part of his income. Their contracts specify strict limits on the distribution of his work, to "protect" their interests...
BTW you guys may have heard that whenever Dean Martin was broke, he would sell someone a share of his future income for a cash "investment", eventually he had promised several thousand percent of his earnings (but he wasn't a songwriter).

Maybe the "hall" style reverb the engineer used on the live set was left on for the interview? Or was the interview not done right after the set? Actually, the big reverb sounded cool on the interview, like a Murray the K old-style AM radio sound
